Regulatory changes

Many articles of the Civil Aviation Code were repealed on 1st November 2023. Yet some of them concern us directly, such as article R. 330-1, which defines the flights we are allowed to make in a microlight with a paying passenger.
Decree 223-1008 went unnoticed when it was published. With good reason: it repeals articles of the Civil Aviation Code but restates the same provisions by creating new articles in the Transport Code. Local flights, for example, are defined in article R6412-4 of the Transport Code (which replaces article R. 330-1 of the Civil Aviation Code): "For the purposes of this article, a local flight is a flight without a stopover whose departure and arrival points are the same, during which the aircraft does not go more than forty kilometres from its departure point and, except for single-seat or two-seat low-powered aircraft known as microlights, lasts less than thirty minutes between take-off and landing."
Similarly, the provisions of articles R. 431-1 to R. 431-10, which deal with the disciplinary sanctions applicable to non-professional flight crew, are restated in articles R6530-1 to R6530-13 of the Transport Code.
The same goes for many other articles.
The decree provides that the repealed provisions are automatically replaced by the new references. There is therefore no break in continuity, and above all no change in microlight practice.
